Residence card – temporary residence permit is the most popular application for an extension of stay in Poland by foreigners. There can be many grounds for temporary stay. Of course, the most popular among them is work. This article describes, in our opinion, a comprehensive and complex topic of obtaining a temporary residence permit.

A residence card is a document issued by a voivode to a foreigner who received a temporary residence permit in the territory of Poland by the Voivodeship Office, competent for his residence. Residence card is a document that not only confirms the identity of the foreigner during his stay in Poland, but also gives him the right to repeatedly cross the border without obtaining a visa. After receiving a temporary residence permit and printout of the card, a foreigner must personally pick up his card in a time!

The residence card is given to a foreigner for a period of up to 3 years in Poland.

Depending on the type of temporary residence permit a foreigner submits the application (most often) personally, not later than the last day of legal residence in Poland to a voivode competent for his place of stay. When a foreigner is applying, he must provide fingerprints and the original valid travel document (passport). The temporary residence permit is granted for a period of from 3 months to 3 years with the possibility of applying for the following permits.

You are legally stay in Poland after applying and if you have met two basic conditions.

If the motion for a temporary residence permit was filed on time (no later than on the last day of legal stay in Poland), and the application did not contain “formal lack” or if they were have corrected within the allotted time, the voivode drives into the foreigner’s travel document a stamp that confirms the filing of the application. Stay of a foreigner is considered legal from the date of applying until the day of submitting a final decision about granting a temporary residence permit.

Stamps in the passport do not give you the right to travel within the Schengen Area.

Attention!!! Placement of a stamp in the passport gives the right for foreigner to stay only in Poland. This does not give him the right to stay or travel to the Schengen countries.  Of course, a foreigner can return to his Motherland, but in order to enter Poland back, he must obtain a visa or use the opportunity to enter the visa-free regime (in this situation one must necessarily have biometric passport).

The issuing of a decision by a voivode to grant a temporary residence permit to a foreigner is conducted no earlier than one month after the commencement of the examination. This is due to the need to analyze evidence and obtain information about foreigners from such bodies as Border Guard, the Voivodship Police Headquarters (the police check the foreigner at the place of residence) and the Internal Security Agency (check whether foreigner’s presence is a threat to public defense or public order).

Residence card – temporary residence permit – makes a huge line for applying documents throughout the country.

However, in practice obtaining such a permit, depending on the voivodship can last from 3 to 12 months. This is due to a large number of cases, simultaneously conducted by the voivode regarding foreigners.

Depending on the type of temporary residence permit, the list of documents to be submitted is also different. Documents required during the visit in the Voivodeship Office:

  • completed application for temporary residence;
  • four actual photos with dimensions of 35 mm x 45 mm;
  • a photocopy of the valid travel document (original for inspection).

Depending on the type of temporary residence permit, the necessary documents for processing the application are also:

  • information of the headman who is competent for the foreigner’s main place of work, the inability to meet the employer’s staffing requirements on the basis of the registers of the unemployed and job seekers, or the negative result of the recruitment organized for the employer(job);
  • documents confirming sources of stable and regular income sufficient to cover living expenses for oneself and family members on maintenance (for one person – above 634 zł per a month, for a family member – 514 zł per month) – for example, the relevant agreement(work and stay with family);
  • and documents confirming official medical insurance in the understanding of the law of August 27, 2004 on public health services financed from public funds, or confirmation of coverage for expenses for treatment by an insurer in Poland – for example, a corresponding certificate from ZUS, an insurance policy(different types of permits);
  • also documents confirming the possession of this place of residence – for example, confirmation of a residence permit, an apartment lease agreement or an application from the owner of a home to provide it to a foreigner(different types of permits);
  • report on the amount of income (loss) in the tax year – PIT-37 (if the foreigner performed work in previous years)(job);
  • confirmation from the university about the beginning or continuation of studies, or about admission to the preparatory course(study);
  • documents confirming the availability of sufficient financial resources to cover the cost of living and return to the country of origin, as well as the cost of study(study);
  • document confirming the beginning or continuation of research(the science);
  • diploma of the Polish University(a graduate is looking for a job);
  • current certificate of civil status(stay with family);
  • birth certificate of a child(stay with family);
  • documents relating to the conduct of economic activities, such as the company’s contract, the company’s balance sheet along with the current profit and loss account, documents confirming achievements during the tax year prior to filing the application, income not less than the twelfth frequency of the average salary in the third quarter of the year, prior to the filing of the application or documents confirming the availability of funds enabling them to fulfill these conditions in the future(entrepreneurial activity);
  • agreement on the acceptance of a scientist for the purpose of implementing a research project, concluded with a scientific group based in Poland(the science);
  • a written statement of the scientific unit in which it undertakes to bear the costs of the scholar’s stay on the territory of Poland, as well as the costs of his return(the science);
  • documents confirming cooperation with the competent authority for conducting proceedings in the case of the crime of trafficking in persons (victims of trafficking).

I. Work in the territory of the Republic of Poland.

1. Uniform residence and work permit.

Permission granted to foreigners who want to start or continue working in Poland.

Permission is also granted to foreigners who intend to start or continue working to hold a position on the board of a joint-stock company. Or a limited liability company whose share (shares) don’t belong to a foreigner and the company that it manages or will manage meets the relevant requirements.

2. Temporary residence permit for the performance of highly qualified work.

Permission granted to foreigners whose purpose is to perform highly skilled work in Poland, that is requiring a foreigner full higher education or at least 5 years of professional experience at a level commensurate with the level of qualifications obtained as a result of the completion of higher education necessary to fulfill this work.

ATTENTION!!! The amount of the minimum annual gross remuneration required to issue a permit cannot be less than the equivalent of 150% of the average remuneration in the national economy in the year preceding the conclusion of the contract announced by the President of the Central Statistical Office.

3. Temporary residence permit for the work of a foreigner who is delegated by a foreign employer to the territory of the Republic of Poland

Permission is issued to foreigners who are assigned to work in Poland by a foreign employer.

II. Studies and Science.

1. Temporary residence permit for the purpose of studying at the university.

Permission granted to foreigners whose purpose of stay in Poland is to study on a full-time form at a university or on a full-time doctoral form, as well as for foreigners who intend to take a preparatory course to begin studying on such conditions in Poland.

2. Temporary residence permit – training.

Permission for foreigners whose purpose is to study on the territory of Poland in a different form than full-time studies at the university or day-long training in doctoral studies, or a preparatory course for such training in Poland.

III. Graduate that is looking for a job.

Temporary residence permit – for a graduate of a Polish university who is looking for a job.

The permit is issued to a foreigner who graduated from the Polish university and is looking for a job in Poland.

IV. Stay with family.

1. Stay with a citizen of Poland.

1.1 Temporary residence permit for a family member of a citizen of Poland.

A permit is issued to a foreigner who is a spouse of a Polish citizen. Or minor children of a spouse of a Polish citizen who has a temporary residence permit for a family member of a Polish citizen.

ATTENTION!!! Minors of a citizen of Poland are granted a permanent residence permit.

1.2 Temporary residence permit – relatives of a citizen of Poland.

Permission granted to family members of a Polish citizen, with the exception of a spouse or child, due to financial dependence on him or being with him in the family, in the country where the foreigner has arrived, or for serious reasons of health, which requires the personal custody of this citizen.

1.3 Temporary residence permit – family life with a citizen of Poland.

Permission granted to a foreigner who leads a family life in the understanding of the European Convention for the Protection of Human Rights and Fundamental Freedoms, with a Polish citizen with whom he or she live together in Poland.

2. Stay with citizens of third countries.

2.1 Temporary residence permit for family reunification.

Permission for persons arriving or residing in Poland for the purpose of family reunification, family members of foreigners residing in Poland on the basis of one of the following residence permits:

  • on the basis of a permanent residence permit;
  • based on a residence permit for a long-term EU resident;
  • in connection with the granting of refugee status;
  • in connection with the provision of additional protection to him;
  • at least for 2 years on the basis of subsequent types of temporary residence permits, including immediately before applying for a temporary residence permit for a family member – on the basis of a permit issued for him for a period of at least one year;
  • on the basis of a temporary residence permit for research purposes;
  • on the basis of a temporary residence permit issued for the purposes of scientific research, when a foreigner has the residence permit referred to in Article1, Charter 2 of Council Regulation No. 1030/2002 with the annotation of a “scientist” issued by another member state of the European Union, if an agreement on the admission of a foreigner for the purpose of carrying out a research project concluded with the competent scientific subdivision of that state provides for the conduct of scientific research also on the territory of the Republic of Poland;
  • on the basis of a temporary residence permit for the purpose of performing highly qualified work in connection with the granting of a residence permit for humanitarian reasons.

2.2 Temporary residence permit – a minor child of a foreigner who was born during the period of validity of a national visa or temporary residence permit

A permit issued to a minor child of a foreigner who is on the territory of Poland on the basis of a national visa or a temporary residence permit if the child was born during the period of validity of this national visa or temporary residence permit.

2.3 Temporary residence permit – due to other circumstances.

A permit issued to a foreigner who can prove that there are other circumstances that justify his stay in Poland for more than 3 months, other than those specified in the Act on Aliens.

Most often this permission is issued to family members (spouse, minor child) of a foreigner who applied for a temporary residence permit and who is waiting for a decision or who has already received a temporary residence permit, but who has not lived in Poland for more than 2 years.

V. Entrepreneurial activity.

Temporary residence permit for business purposes

Permission granted to foreigners whose purpose is to conduct business in Poland.

This permission is also granted to foreigners whose purpose of living in Poland is to act on the board of directors of a limited liability company or joint-stock company whose shares or moieties belong to a foreigner or the conduct of business of a limited partnership or a limited joint-stock partnership with a common partner or as an authorized person.

ATTENTION!!! In order to obtain this permission, the enterprise that conducts economic activity must generate a certain income or create jobs, or have appropriate means or actions to meet these conditions in the future.

VI. Scientist.

Temporary residence permit for research purposes.

A permit granted to a scientist, who is a foreigner with at least a professional rank corresponding to a master’s or equivalent degree in Poland, which allows access at least to a doctorate whose purpose in Poland is to conduct research or development on the basis of an agreement on its acceptance for implementation of a research project, concluded with a scientific unit located in the territory of the Republic of Poland.

VII. Victim of human trafficking.

Temporary residence permit – victim of trafficking in persons.

Permission granted to a foreigner who is a victim of human trafficking, if at the same time he fulfills the following conditions:

  • is located on the territory of the Republic of Poland;
  • cooperated with the competent authority for the conduct of proceedings in the event of a crime specified in art.189 § 1 of the Criminal Code;
  • stopped contacts with people suspected of committing a crime, mentioned in art. 189 § 1 of the Criminal Code.

VIII. Stay due to exceptional circumstances, including illegal stay.

1. Temporary residence permit – circumstances requiring a short stay.

Permission granted to a foreigner residing in Poland if:

  • he is indebted to a personal appearance before the Polish state body;
  • The presence of a foreigner in Poland requires his unique personal situation;
  • The presence of a foreigner in Poland requires the interest of Poland.

2. Temporary residence permit – due to the need to respect the right to family life.

Permission granted to a foreigner if his stay in Poland is necessary. Because of the need to respect the right to family life in the understanding of the Convention for the Protection of Human Rights and Fundamental Freedoms prepared in Rome on November 4, 1950, and the foreigner is illegally located on the territory of the Republic of Poland

3. Temporary residence permit – the need to protect the rights of the child.

A foreigner is received if his departure from Poland violates the rights of the child as defined in the Convention on the Rights of the Child adopted by the United Nations General Assembly on November 20, 1989, to the extent that it significantly threatens his psycho-physical development, and the foreigner is illegally in the territory of the Republic of Poland.
